SHIPPING, RETURNS AND TAX POLICIES

ShopperOne® Online Mall (d.b.a. ShoppperOne.com, Cuda Kitchen, Cuda Coffee, The Popcorn Machine, The Snowcone Machine, Concession Site and Cuda Coffee Vending was designed to allow easy access to all the options in our products and accessories lines. We have attempt to make shipping and returns as painless as possible.

General Returns

Defective products must be returned within 30 days after the product was purchased (this time varies for some manufactures). You must call for a Return Goods Authorization (RGA) number PRIOR to returning any items purchased through us. We will not accept any returns without a RGA.

If Cuda Zoo, LLC. finds that any product returned is not defective, such product shall be shipped back to buyer at their expense. Products returned within 30 days that are not damaged and conform to our returns policy are subject to a twenty-five (25%) percent re-stocking charge plus the return shipping charges; if returned products are accepted and retained by Cuda Zoo, LLC.

Custom Orders Cancellation

Orders placed for custom equipment may take from 30 to 90 days to be delivered. The cancellation or delivery rejection of all orders with custom equipment are subjected to a 25% custom order restock fee.

Commercial Products Returns and Limited Warranty

Warranty as provided by manufactures.

No returns on commercial products except for defective equipment. Defective Products must be returned within 30 days after the product was purchased. You must call for a return goods authorization (RGA) number. We will not accept any returns without an RGA.

If Cuda Zoo, LLC. finds that any products returned is not defective, such products shall be shipped back to the buyer at their expense or products returned within 30 days that conform to the invoice and are not damaged shall be subject to a twenty-five (25%) percent re-stocking charge plus the return shipping charges if the products are accepted and retained by Cuda Zoo, LLC. All sales of commercial products are considered a sale to a business. We do not sell commercial to individuals.

Limited warranty applies on all commercial products in the United States. Cuda Zoo, LLC. honors manufacture warranties for parts (not labor) for a period of one year from date of purchase.

Other Limitations and Exclusions

Any implied warranties including fitness for use and merchantability are express warranty set for the above and no person is authorized to assume for Cuda Zoo, LLC. any other liability in connection with the sale of the products. Cuda Zoo, LLC. expressly disclaims liability for incidental and consequential damages caused by the machine. The terms "incidental damages" refer to the loss of the original purchaser's time, loss of the use of the products or other costs relating to the care and custody of the machine. The terms "consequential damages" refer to the cost of repairing or replacing other property which is damaged when this product does not work properly. The remedies provided under this warranty are exclusive and in lieu of all others. This warranty gives you specific legal rights. You may also have other rights which vary from state to state.

Any issues involving this these terms and the purchase of commercial products shall be governed by the laws of the state of Florida and any person purchasing commercial products from Cuda Zoo, LLC. agrees that any lawsuit shall be litigated in state of Florida.

We reserve the right to cancel any order for any reason. Possible reasons for cancellation include, but are not limited to the following:

  1. Potentially fraudulent order. Before shipping orders, we run a check to make sure all orders are legitimate. If the check fails, we may cancel your order.
  2. Typo/Incorrect pricing. Due to constant updating of new and existing products including pricing, specifications and product pictures to Cuda Family of Websites, we reserve the right to remove, correct or cancel any item from any order.
  3. Non-Payment. If payment is not received within a reasonable amount of time (currently 30 days) after the order has been placed, we may cancel an order without notice.

 

Cuda Zoo, LLC uses reasonable efforts to include accurate and up-to-date information on the Site, but does not warrant that it is free of errors or omissions. Because of continuing improvements, actual products may differ slightly from photo. Photograph images may have been retouched and or slightly different from the original item. Cuda Zoo, LLC will not be liable for any damages to the end-user, whether direct, consequential or incidental, arising from the end-user's use of, or reliance upon, material presented at the Site. Cuda Zoo, LLC will not be liable for any damages to, or viruses that may infect, your computer or related equipment as the result of your access to, use of, or downloading material from, the Site. Cuda Zoo, LLC is not responsible for the contents of any off-site pages or any other sites linked to the Site.

Food Products

No returns on food products.

Accepted Credit Cards

We ask that all orders be placed online via credit card payment — on our ShopperOne® shopping cart checkout you have options to pay with Authorize.net® secure credit card processing, PayPal® Express or simply call us at 866-411-2832 to take your payment information over the phone. We accept all major credit cards: Visa®, MasterCard®, American Express®, Discover®, Diner's Club, JCB. Please note if a charge back is initiated by the customer for an order placed on our sites and the charge is not fraud and was placed by the customer there will be a $15.00 fee charged.

Taxes

Cuda Zoo, LLC. headquarters is located in the state of Florida and 6% state sales tax will always apply to purchases done in Florida. All orders shipped outside of Florida are subject to manufactures' headquarters location and destination state's tax laws — our ShopperOne® shopping cart sales tax calculator gives you a fair estimate of state sales tax charges. In case your order is taxed according to your destination state rate does not match our online estimate, we will contact you to confirm your purchase prior to shipping. States are constantly changing their sales tax laws & regulations we strive to update our systems as these changes happen. Other taxes and fees may apply to countries outside the US.

Shipping and Customers Reponsibilities for Deliveries

Our standard shipping rates apply to the lower 48 states in the US. If you are outside this area you may be charged an additional shipping fee only to cover the cost of shipping your item. Shipping Charges are an Estimate Only. Charges may be revised to accommodate over weight, over sized, expedited and shipping destinations.

Shipping Terms & Conditions - Customer Instructions/Responsibilities for Deliveries

  1. Inspect the entire shipment for visible damage prior to accepting the shipment, and note any damage on the delivery ticket/bill of lading before the delivery person leaves. Refuse delivery of any items with damage. If damage is found after driver has left - customer is responsible for filing claim with carrier and supplier is unable to accept any liability.
  2. Verify the number of packages delivered with the packing slip provided.
  3. Unpack your order immediately and inspect for hidden or concealed damage, missing or incorrect products.
  4. Should any damage be discovered, retain the shipping carton and any inner packaging intact, request inspection immediately from the carrier as well as make a written request to the carrier.
  5. You are responsible to report concealed damage or loss which was not noticeaable at the time of delivery and is found after unwrapping or sopening the box your item was shipped in, if you fail to report the damage within 7 days  after the delivery date, the claim will more likely be denied by the carrier. 
  6. If you sign the delivery receipt as a clear shipment (no damage noted), you are accepting the shipment as is with no recourse with Cuda Zoo, LLC and you will be responsible for any claim procedure along with its outcome.
  7. If there is any damage (visible damage or concealed damage with the item refused the order) or contact customer service at 866-411-2832 and or email us at customercare@cudazoo.com to advise of the damage.

Please have our order number, shipping information and any available tracking number ready so we can assist in the process if possible.

Do not attempt to return any item without a return authorization. Unauthorized returns cannot be processed and all costs are the customers responsibility. No returns after 15 days from invoice date.

Orders are shipped UPS, Federal Express, USPS or Common truck carrier, usually 24-48 hours after receipt of order. The exception to this is if the equipment is built to order.

Free shipping and handling, if offered, is available in Continental (except Alaska) US only. Availability of select products vary and quantities may be limited.
